Help ppeal to IAS or not - UKCPS

    I was able to find all my claim details when looking to login an IAS appeal online (car registration and Claim number).
    I would look on the IPC website for 'complain about an operator' and tell them that you have been promised IAS but the PCN is not showing on the system. Don't let on you know anything!

    I have complained on the IPC website as advised and received the following message:

    The effect of suspension is that the company will not be able to make any applications to the DVLA for vehicle keeper data until such time as their membership with an Accredited Trade Association is restored.

    The company may still issue parking charges during a period of suspension, however, they will not be able to apply retrospectively for data for any Parking charges issued during a period of suspension once such a period has expired. It should be noted that this does not prevent them pursuing charges – it simply effects their ability to apply for and obtain keeper data in order to do so.
    The suspension will not affect your ability to appeal to the IAS.
    I have checked the system and your PCN is now on there so you can appeal, the PCN number is 2168601.

    So, given this message it seems like that everything I got left is appeal via IAS?

    You can, but it's unlikely you'll get anywhere with IAS.

    Just maintain your stance that you won't name the driver. They can't do anything then.

    If you want to be a test-case, you **COULD** try appealing to IAS with a single appeal point of "I wasn't the Driver. I am the RK. I am not obliged to name the Driver, and therefore will not. UKCPS cannot access RK data, and therefore cannot pursue me as RK. Elliott -v- Loake doesn't apply. No presumption applies (ref. Henry Greenslade)."

    I wouldn't expect much though.

    Suppose they can still pursue the Driver - assuming they know who it is. Just makes it even more important to not name them.

    Don't try the IAS, just ignore this now. Come back if you get a (rare) claim later on.
