Confirmation of Scottish information in newbie thread

Hi
So the newbie thread states "If you stay in Scotland or NI please do complain to the retailer but do NOT appeal, DO NOT GIVE AWAY WHO WAS DRIVING (see below section about Scotland/NI specifically)."
I live in Scotland but my tickets were both issued in England, Private one being Newquay Fistral beach. So from the information in the newbie thread I am unsure whether I follow the advice for England and Wales or the advice for Scotland and NI?

If it's Smart Parking then you may as well use the template appeal in blue in the NEWBIES sticky thread, which will get you a POPLA code (because this was on private land in England).
Then you win as a 'keeper' appellant at POPLA, because Smart Parking don't use the statutory words to hold keepers liable.
Personally I would do that to stop the stupid debt collector letters like these people are getting:

The difference with them is, they parked in Scotland so they can ignore it - now the chap with the hire car has taken the Hire firm out of the equation - and those two posters *should* not get POPLA offered.
But you will...or Smart will give up & cancel!
Your alternative position is to endure & ignore the debt letters, as explained in the link I just posted there.
Personally I would do the appeal then POPLA as 'keeper' using our templates (POPLA appeal is longer, not the same appeal as the one in the NEWBIES thread). Because Smart parking are 100% beatable by a keeper who never says who parked/was driving!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for the info coupon mad. Think I might just use the template although I don't mind causing the debt collectors a little extra work lol. The worst point is I paid at the machine at the top of the hill then drove down closer to the beach when I saw there were spaces available. I didn't see any info separating one car park from the other. It's a disgrace that the establishment allows these bully boys free rein.
I was also looking for information on Council issued PCN's. Is there a section on here with the best methods for dealing with them?
I was ticketed in Appledore Churchfields, car park by Torridge District Council where the meters and signage were in complete darkness. Except for the machine which was flashing a red led and an out of order message. I didn't see the other meter or the pay by phone signage as they are in the darkest corner of the car park and were completely unlit and invisible. I just saw the scan and upload info in the Welcome useful links so I'll get that organised and post again0 -

Just to update my thread on the outcome of these PCN's.
Torridge DC cancelled my ticket when I complained about the lack of lights in the car park and the fact that their machines and signage were all in complete darkness.
I sent the blue template reply in the newbie thread to smart parking and got a reply 4 weeks later telling me they had cancelled my ticket lol.
