Parking Eye PCN at hospital when the machine was bagged and the barrier up?

I've just received a PCN for an overstay at the RUH in Bath in September. When we arrived the main car park was closed and the smaller one at the maternity wing was open, but the ticket machine on entry bagged over and the barrier up, so no way to get a ticket.

I have two dates of issue on this letter, 18/10 and 01/11. The date we parked was 20/9.
As I understand it from the POFA 12 this PCN should have been issued to me as the keeper within 14 days (Paragraph 9: 4b and 5)

Is that right? So I can reject it under that section of that act? What a pain in the **** this is!

    If it's an ANPR NtK ONLY (i.e. there was no windscreen ticket), then yes, they only have 14 days beginning on the day AFTER the alleged incident (i.e. 15 days FROM the incident) to have a ticket in your hands.

    If they're alleging there was a windscreen ticket placed, then the rules change slightly.

    Either way, send of the appeal letter for BPA members from the **NEWBIES** thread. You may or may not wish to amend it to include the additional information you present above, but in any case, take care to *NOT IDENTIFY THE DRIVER* and appeal as Registered Keeper only.

    They will likely reject, so the purpose of the exercise is to get a POPLA code, at which point come back for more help and guidance.

    Edit your post to remove reference to 'me, myself and I', as currently you've identified yourself as the driver. PPC reps do browse these forums, so don't identify yourself in any way.
