Swimming lessons money back

Hi everyone

I booked private swimming lessons for my children for a 10 week course paid in advance online via credit card. The idea was consistent one to one with the same instructor (as to build trust with children). On the 2nd lesson our instructor had to take another class due to a previous instructor quitting. On the 5th-8th lesson our instructor had gone off sick. There was no communication from the office stating that our lessons would be cancelled. Only turning up for a lesson and then having to chase up the office asking where our instructor was did I get a "oh you're not booked for anything today" kind of response. I put a complaint in asking for my money back on the messed up lessons and the remaining lesson as I have had enough of being messed around. The email was acknowledged via head office and I was told a local coordinator would get back to me. After a week I received an email from said coordinator saying someone else would start covering lessons and my messed up ones would be added to the end. I don't want this, I want my money back.

I would like to know what my consumer rights are in regards to getting my money back for half of what I paid for. I've searched but everything seems to point to goods and services so I don't know what this would fall into with regards to how I would approach it. The company has no terms and conditions as such regarding bookings so I can't see what to do next.

    If you have the website can you post the link so we can take a look.

    Where you sold specifically one to one or was that just something they said would happen? I can imagine their defence being that you purchased swimming lessons and they are still offering those lessons.

    They do group sessions and one to one sessions. I specifically booked one to one sessions.

    There's some connection with bannatynes who don't have a great reputation.
    Have you thought of posting something succinct on their Facebook page ?

    Contracts for goods are like when you buy a tv - the tv is goods so rules for goods apply to those contracts. When you pay someone to do something for you - to provide a service for you, its a service contract. If you buy like an ebook, goods that exist only electronically then the rules for digital content apply.


    You might want to remind them of their own terms though:
    If due to unforeseen circumstances there are insufficient teachers to safely conduct the course or the session, we reserve the right to cancel the said session or course as the safety of our students is paramount. If for any reason a teacher cannot attend a session, we will either ask another teacher to take over that session, or if no other teacher is available then payment will be carried over and deducted from the next course or refunded if you no longer wish your child to attend the lessons after the current course.

    Went through the steps to book a course - if they allow you to book online, T&C's have to be somewhere unless they completely dont have a clue.
