hp on car

hi i was wondering if anyone could help us my partners dad passed away this year on april 13th he had a renault megane and only had it 3 weeks we rang dvla and they told us on how to put the log book in my partners name which we have done and insurance , we now what to get rid of the car as its not suitable for us so my partner went to a garage to part exchange it when they done a check the found it still had outstanding finance on it we have had no letters on the car nor has my partners dad how do we stand as we dont no what to do now next any body that could help us we would really appricate it we are having one headache after another i cant see why anyone would give finance to a 77 year old man thanks does it mean we will be stuck with the car forever

  • are you sure the finance is from your partners dad and not a previous owner ? was it hpi checked when he brought it.
  • yeah we found out after he passed away that he had the finance but he didnt even get around to making the 1st payment and no one from the finance company has never been in contact with us
  • You need to make contact with the finance company yourselves as the car is now in your name at the DVLA and you are technically the carriers of that debt to the HP company - and manage the situation. You can't sell the car with a debt on it as few folk (in their right minds!) will buy a car and assume someone elses debt.

    Contact their customer services team, explain the person who took the finance out passed away under a month after the agreement, and at present you cannot find any paperwork (although I'm amazed they have not been writing to him chasing outstanding payments?) - ask them for advice on how to get the finance terminated painlessly under difficult circumstances for yourself - although it may cost you until you can get it sold again as you'll have to assume the debt yourselves.

    ...unless he took out any payments insurance to cover any potential inability to pay?? If his death has appeared on Mortascreen or/and the Bereavement Register, then the HP firm may already be aware of his death and claimed the money they're owed against insurance he may have taken out as part of the agreement?

    It can take some months for names to appear on the two commercially accessible death registers though...
