UKPC -Court Proceedings PoFA

So, I'm going to court as I was convinced my lease superseded any contract with UKPC, now I'm not so sure. UKPC are persuing me under keeper liability for parking outside of marked bays on 4 occasions in our residents free car park. I've asked for a copy of the contract with the 'landowner' but received a 'witness statement' from Michael Elliott of UKPC saying they have authority from my managing agent (have named them) and can produce the contract in court if required. 1st offence 5/1/16. Nth dated 4/2/16. My partner appealed online in my name (he was driver) but we don't know what date. UKPC acknowledged 25/2/16 saying charge on hold for 35 days. Appeal rejected 7/3/16. If they were considering 'my' appeal was I still required to give driver details within the 28 days if it's on hold?

    have you spoken to the managing agent?


    1: are they happy to see you in court?


    2: have they told UKPC to take you to court?

  • Are you going to court? Have you received an official court claim?

    The witness statement is pretty much worthless, in that you will demand to see the contract before court.

    As UKPC are known to lie, what does the landowner think of this ?? have you asked ??

    I haven't spoken to them however I had previously received correspondence from the M/agents that they had appointed new parking controllers 2yrs ago, but assumed it was 'unofficial' and more so to deter non residents.

    Court date is set for 20/12/16 and all documents supposed to be in 4pm tomorrow 21/10/16

    I thought a court date was set AFTER they had received sall the papers from both parties and ask which court , and checked allocation availability

    Yes that's right, I submitted a defence, but you also get the opportunity to submit any further documents you want to rely on in court, which is where I'm at.

    The 'charge' referred to in my initial post is how they refered to the situation following my appeal (before any court proceedings which started in April.
