Tenancy Deposit Scheme

Hi,

Our landlord isn't responding to emails requesting a return of our deposit for our tenancy which finished a few weeks ago. It's hardly surprising since he rarely responded to email throughout the tenancy.

It is protected by TDS, and the agent has offered to transfer it over there if we want, but cautioned it could take up to three months for them to resolve it. I'm cautious about doing that since right now he could release it with a single email - if it goes to TDS it's guaranteed to be more work, and he seems to have a serious allergy to that!

Does anyone have any experience with TDS? How quickly will they look at it, and what sort of evidence are they looking for? Will we be able to just forward them the emails when asked? Surely that's open to false evidence? If he continues to not respond, would TDS eventually find in our favour?

    The TDS would eventually release your deposit, but the agent is correct in that it will take time (especially if the LL ignores it)


    Make a single claim to the TDS now and avoid delay
