Parking outside bay at NCP Gloucester Blackfriars

Have searched forum for similar cases but unable to find anything recent. My vehicle was parked on an end bay with no parking bay to left hand side and admittedly was parked over the bay lines because the car parked to the right of mine was also over the lines. Received windscreen PCN and then Notice to Keeper letter. Appealed to NCP via e mail as registered keeper of the vehicle, at no time have I admitted who the driver was. In a nutshell explained to them my vehicle was not encroaching on any other parking space and therefore they suffered no loss. Ticket was paid in full for the duration vehicle was parked and asked that they cancel the charge. Lo and behold, got an e mail rejecting the appeal,. They mentioned the ParkingEye v Beavis case, but that case was different to this one. They gave me the option of paying a discounted amount of £50 within 14 days or it will go back up to £100 or I can appeal to POPLA and they have given me a verification code. Asking for advice on what to put in my appeal to POPLA as I cannot find anything similar on the forum. Many thanks

The template POPLA points are in 'POPLA Decisions', the thread you will surely have looked at already, at the top of the forum. Penultimate page, you can use 4 or 5 of them, I'm sure.
You do not need to find a case the same. Please confirm that you have NOT implied who parked, as your description of your appeal sounds like you made up your own appeal rather than using the template first appeal in 'NEWBIES PLEASE READ THESE FAQS FIRST'?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you for your reply, Don't think I have implicated myself but would ask for your suggestions. Unfortunately only discovered this site after emailing my first appeal.
This is what I put:
I, as registered keeper of xxx reg no xxx have received the above PCN no xxx and wish to appeal on the following grounds:
The vehicle was parked in an end bay with no parking bay to the left hand side and was parked over the bay lines to the left hand side simply because the vehicle parked in the bay to the right hand side was encroaching on the end bay and in order for the driver of the vehicle parked in the end bay to be able to get out of their vehicle had to park further over to the left hand side thus parking outside the bay lines.
However in doing so, said vehicle was not causing any obstruction or encroaching on any other parking space as it was an end bay.
A parking ticket was obtained and paid in full for the duration that the vehicle was parked. Therefore there was absolutely no loss of revenue for NCP or the landowner and as BPA Code of Practice states the amount of parking charge must be based on a genuine pre estimate of loss suffered as a result of breach of contract, I would respectfully ask that you kindly cancel the parking charge notice.
THEY OF COURSE REFUSED !!! Your comments would be appreciated.0 -
Please break up your walls of text as reading a block like that is very difficult. Many regulars ignore such posts, so you're disadvantaging yourself needlessly. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Your key to winning this will probably lie in court as POPLA simply look at the T&C on the signs and ask if you broke them (IAS don't even look at the signs and only read your appeal in order to (a) get their fee from the PPC and (b) get your address to send the rejection to)
If it gets anywhere near court, you will ne lots of photos of the signs and your parking place.0 -
Good, you didn't give away the driver.
So, the registered keeper will now win at POPLA with the right appeal; the way to do that is already explained:You either search 'NCP POPLA' to find one from recent months to copy from, and/or you can use the template POPLA appeal points myself and a couple of other posters contributed to in September, which suit all cases, pretty much.
