PCN from Merton Council

Received PCN from Merton Council today 17/10/16 date of contravention 31J box junction on 28/7/16. Nearly 3 months later! The vehicle in question was a courtesy car given to my OH while his was in for major repair after a lorry driver decided he liked the look of our brand new car at 70mph. Incidentally the courtesy car was handed back round the same time as the contravention. No paperwork was signed when he was given this car, he was just given the keys, we did question it at the time & were told they'd sort it later. It did go to the back of our minds as there was a bereavement in the family the next day.

Fast forward this is not a NTO but PCN, it should have been issued to the repair company & not my OH? The DVLA should not have had his details listed as the owner for this vehicle at any point.

There is just the PCN addressed to my OH, should it be addressed to the repair company as they own the vehicle, we have not received any correspondance from them at any point in regards to this, surely we should have been notified about this sooner than receiving the PCN today. The footage only shows the rear of the car not who is driving, we have watched the footage & I'm not sure the PCN is valid.

Do we have other grounds to tell Merton to stick it? All of the courtesy vehicles are identical, plates could have been swapped for whatever purpose especially as we were not happy with the repair & complained to both them & our insurer as unlikely as it seems.

    So this is a 'proper' Penalty Charge Notice issued under either the Road Traffic Act or under local parking restrictions from the council / by the constabulary? As in not from a private firm?

    The repair company will have passed on your details to the council after they received the notice, as they are entitled to do, and as would have been done by any private firm had this been a hire car from (say) Enterprise or the like.

    You'll be better off on the Pepipoo forums - this is really only a forum for dealing with the private parking firms, like ParkingEye and the like.

    Follow Carthesis advice about pepipoo but I would never accept a hire/loan vehicle without any paperwork, you are leaving yourself open to all sorts of trouble.
    Any company worth their sorts would have also insisted on a contract with timings on it too for their own protection, this looks messy!
  • tried registering with pepipoo but am yet to receive authentication email, its from merton council themselves under 2003 act, not a private firm i know what to do with them. weren't happy with it & tried to get paperwork to confirm loan of the car until it was ours was fixed but got nowhere & shoddy repair as well which we complained about to them & privilidge got nowhere with that. if it is the case surely someone would have notified us this was pending?

    You can't use a hotmail email account on pepipoo...try again with another one if you tried a hotmail one.
