Hi all, last September I received a parking charge notice from CE Ltd and I appealed within the 28 days using one of the templates similar to the to the one I had used before when I appealed to the parking charge sent by Parking Eye; an appeal that was allowed.

While away from home CE Ltd sent me a letter requesting that I give them the name of the driver and address within 7 days in order for them to further investigate the matter. I have decided not to do this, am I right? And my other question is should I respond to this letter, telling them that I refuse to give them the name of the driver, or should I wait for their next move. Any advice or suggestions? And before anyone asks yes I have been to KFC and talked to the manager and got no help at all. I mean, my family have been to this branch of KFC many times and have never had any issues before and on the day in question there were so many people that it took so long to make an order.

P.S. the 7 days have already lapsed.

    Have you read the Sticky thread for NEWBIES? A lot of things have happened in the unregulated parking industry.


    CEL are BPA members. The DVLA told the BPA to tell their members to stop asking motorists to give away the driver's details.

    Complain to the DVLA and BPA about this.

    When you get the inevitable rejection and PoPLA code from CEL, generate your PoPLA appeal and post it here for the regulars to check over before you send it.

    Read the POPLA Decisions sticky thread and pick the relevant parts from the most recent successful appeals.

    This should include at least, not the landowner, no standing to issue charges, inadequate signage, non-POFA 2012 compliant NTK, and any other relevant points you can find.

  • Yes, ignore CEL's cheeky letter, and await their POPLA code.

    Meanwhile complain to KFC Head Office (go direct to the CEO). Complain both about the parking charge and about the unhelpfulness of their useless managers.

    Yes just wait for the rejection letter. At POPLA stage, CEL will lose v a keeper if you use the template appeal points shown in POPLA Decisions (penultimate page) and copy them into a very long POPLA appeal.

    That gets shot of CEL - they might even give up now when they realise you aren't dobbing in the driver.

  • Thank you very much guys for your advice. Fruitcake, when I get the POPLA code I will definitely post my appeal here for you guys to guide me. Thank you again for that in advance.

    CE Ltd have, today, sent me a reminder letter to the parking charge notice making the usual threats as always. I thought they were not supposed to send this since they have received my appeal. Should I remind them of this or just ignore this reminder?

    I usually ignore reminders, as they are computer-generated. However, as you have CEL's email address, it wouldn't hurt to send them a one-liner reminding them that they can't win at POPLA v a keeper so they may as well hurry up and cancel!

    I mean it, I would email something like that! CEL are so easy to beat at POPLA and they know it.

I have decided to reply informing them that I have appealed the penalty charge and that to date I have not received the POPLA code or do you think I should just ignore this letter as well. Any advice will be appreciated.

    its not a penalty charge , so remove that from your head

    its a parking charge , a speculative invoice

    yes , reply as keeper and remind them an appeal has been made and they should cancel or issue a popla code

    post #6 told you to do this and now is no different

    Never ignore a Letter before Action!

    You need to email a complaint to the BPA and a response to CEL asap. DO NOT set the scene by implying who was driving. Only complain as keeper that you never got a rejection letter & POPLA code and insist that the matter is placed on hold, no claim form can follow.
