Damage deposit on credit card section 75

Hi all

Hopefully a quick quick question with an easy answer.

I paid £500 for a hire vehicle a few weeks ago on credit card, which consisted of £250 for the hire and a £250 damage deposit.

The company have had the vehicle back, confirmed it is in good condition and claim they refunded the money to my credit card on 30th September - however nothing has been credited yet.

They are insistent (despite not being able to show me a refund receipt) that it has been done, but my credit card company say nothing is pending. They refuse to "re-issue" the refund regardless of what I say.

My question is, can I make a partial claim under section 75 (i.e. £250 claim on the £500 total) or must any claims be for the whole amount of the transaction?

    I spoke with the company again and they are "re-issuing" the credit, but I contacted my card company a week later and still nothing pending.

    What are the consequences for a business who have a S75 claim against them? Do they have to pay any sort of fee/penalty if a claim goes against them? Just curious as they were recommended by a friend and I don't want to permanently burn bridges for the both of us (although I personally won't use them again unless I really have to).

    It's at the point now where I'll be paying interest on the amount as I can't afford to pay the deposit off by my next CC bill, so I'll be asking my card company to reverse the transaction if nothing is pending by Tuesday. I refuse to pay interest on something that is somebody else's mistake...
