6 Years n and I've Got a PCN...?

  • I've still not heard anything back from BW from my last reply, mine now will also be over the 6 year limitation, however I did enquire with the national debt agency regarding the limitation act the other day and they seem to think the limitation would start from the moment they could take you to court, ie if you had 14 days to pay the ticket then it would be after the 14 days. So if you got the ticket on 1st November 2010 then the 6 years would be up 15th November 2016.

    I dont know how accurate this is, as I've heard lots of conflicting information. They seem to think its slightly different with private parking tickets, however that was just the advisors opinion. If you read the limitations act it simply says from the time the breach of contract occurred, which one would presume is the date of the initial parking offence....

    It really does not matter, all that matters is that YOU cost THEM as much money as possible. Send in an invoice for your wasted time, if they ignore issue a MCOL. Even if it is just for a few pounds, it makes them spend more money.
    You never know how far you can go until you go too far.

    BWLegal can really do nothing ...... it's timed out now.

    But as their interpretation differs to reality, you might get a reply saying ..... "our client does not use the limitations act"
  • Well as if by magic I received a response from BW legal this morning from my last letter to them, it simply says, in reference to you recent correspondence we have queried your account with our client and have placed your file on hold whilst we await our clients further instructions....

    Have they realised its now passed the limitation date? or are they just giving up... who knows!

    They'll probably sit on it for 6 months and then start the email chain again.

    I quote:

    "We write in reference of the above matter and your recent correspondence.

    We believe that the points raised in your letter dated 7th November 2016 were addresses in our letter dated 2nd November 2016.

    We confirm your position has been noted and we will will now seek our clients instructions on issuing County Court proceedings against you.

    Yours faithfully.

    So my questions are,

    1) Do I need to reply and if so what with.
    2) Or now that we have passed the 6 year point do I just forget about them
    3) Should I counter sue them for deliberate harassment

    I'd remind them that 6 years is now up. Either issue proceedings so a judge can explain this limit to them, given that even though they are solicitors, seem not to understand this basic tenet of civil law, or cease and desist the harassment that you are now experiencing.

    Tell them that you are taking advice in the context of 'Ferguson -v- British Gas Ltd'.
