    judge awared 130 to mil, he dismissed all points raised we privided including debt of sale and also questioned if we obtained help from the internet stating free legal advise was usually worthless

    Others will no doubt be along to add comments, but just goes to show that small claims can be an absolute lottery at times.
    That is the first properly defended claim that MIL have won to my knowledge, unless anyone knows of any others.

    Nope, at least one was lost last year with a lay rep.

    This is ridiculous, MIL had no cause of action, no contract, no right to process your data and no valid assignment at all. terry9999, did you cover all of that at the hearing? Was the Judge asleep?

    Tell us the claim number and court and Judge, please, so we can be fully informed.

    i did cover all these points and he dismissed them all, the only point he gave thought to was signage in the area parked in and wherever it was adiquate and eventually agreed it was adiquate. he seemed annoyed i had not paid for legal advise and went on a little rant about this and the fact he was a 'lawyer'.
    he said i could appeal to a higher judge but it would be extremely unlikely that they would disagree with his rulings. my partner has asked i do not disclose her name on a public forum, however as long as you do not pass this on to anyone or use it i can private message you the details.
    is there anything else i can do or do i need to chalk yhis up to experience? i did read somewhere about suing for breach of data protection this could be a way of clawing some money back?

  • Hi

    Can anyone explain why I am in receipt of form N9B from Mil Collections? I have counterclaim using form N180.
    MIL are saying that my counterclaim is 'struck out an abuse of process and does not constitute a valid counter claim but an unfounded application for costs which no justification or sufficient breakdown has been provided. MIL put the defendant to strict proof as the valuation of the counter claim. They have provided me their email and ask me to respond within 7 days.

    Has anyone experienced or can help?

    Was your counter claim only for 'costs' - if so you've wasted your fee.

    Or was it a carefully worded claim for misuse of data and breach of the DPA Principles?
