Parking Eye South Quays Southampton

I am wondering can anyone help me please?

I got a ticket in a company car for driving into South Quays and back out again. The Company refused to appeal as the owners and gave them my details as driver. Parking Eye have now issued me the same ticket in my name and PE have refused my appeal. I now have to go to POPLA.

Can anyone give me some pointers as I do not know what to do now?

Did you appeal as driver or hirer/keeper? Hopefully the latter.

Please read the Sticky thread for NEWBIES on how you should have appealed and the requirements parking lie should have gone through. See if they didn't follow the correct process, but if you appealed as driver it may make it a bit more difficult.

Also read the POPLA Decisions sticky thread and pick out the most recent successful appeals that you can use in your appeal.

This should include, inadequate signage, not the landowner, no standing to issue charges, and if you didn't reveal who was driving, non-POFA complaint notice to keeper/hirer.

Is the car park covered by Bylaws as this makes a huge difference?

    That's good news, well done.

You should check the parking lie paperwork against the requirements of the POFA 2012 with regard to lease/hire vehicles. I doubt they have managed to get it absolutely correct.
Your task now is to drag this out past 6 months. You should also complain to the BPA and DVLA that parking lie had no business asking for keeper data where Byelaws apply.
PoPLA have currently put all Byelaw appeals on hold so this is to your advantage as it will slow things down for a few weeks.

Have a look at the template POPLA appeal points in POPLA Decisions (penultimate page) and use them to make a draft POPLA appeal for yourself as hirer. Use the 'no hirer liability' one written by Edna Basher as your first appeal point, plus the one I wrote, about the individual appellant not being evidenced as being the person liable. And the one about 'unclear signs not seen', plus 'no landowner authority' and finally throw one in about BPA Grace Periods (search the forum for an example!) if you are saying the car drove in and out within minutes.

    Show us your draft.
