    Ah right yes see what you mean - what a sneaky email - the addy first bit is "no-reply.popla" followed by the parking eye bit - I thought it was from POPLA! 48 pages!! lol have checked the letters and they are the same as sent to me so at least they haven't changed it. They now state on the "evidence" paperwork that only 3 hours was paid for ( £3 ) not enough for the time stayed . This is the first time this has been stated by them anywhere! Fingers crossed that popla take on board that PE didn't follow the correct procedure.
    Show us your comments FIRST, this weekend, which need to be ripping apart their evidence. Short and sweet bullet points, not a re-stating of your appeal.

  • Hi have had no further contact from either POPLA ( had none at all from them so far ) or PE until today when I got an email from POPLA saying they had reached a decision and it was on the portal - their decision is "successful" !


    For info this is what the assessor sent me ( have left out the case number and reg number ):-


    Assessor summary of operator case
    The operator issued a parking charge notice (PCN) to vehicle registration **** ***.


    Assessor summary of your case
    The appellant states has raised several grounds of appeal, including; landowner authority, compliance with PoFA 2012, issues with payment machines, breach of BPA Code regarding ANPR, charge is a penalty under the Consumer Rights Act 2015, inadequate signage


    Assessor supporting rational for decision
    It is the duty of the operator to provide evidence to POPLA of the terms and conditions that the appellant did not comply with and evidence that the appellant did not comply with these terms and conditions. The operator has not provided any evidence in response to the appellants appeal. As such, I cannot confirm whether the operator issued the parking charge notice correctly. Accordingly, this appeal is allowed.


    Many, many thanks to all who responded and helped especially coupon-mad! Not sure if you can tell exactly what POPLA used to decide the outcome from the above.

  • I'm assuming PE, even though they sent me that sneaky 48 page email containing their "evidence", which they supposedly were sending to POPLA , eventually decided to not send it to POPLA as they knew they didn't have a leg to stand on?

  • Or PE forgot to send it? Surely they can't change their mind once a decision has been made? If one or the other has screwed up and a decision has been made then surely that is now between them and doesn't involve me. Reading between the lines of the assessors rational perhaps the "evidence " that PE provided to them was not considered "evidence" by the assessor because it simply didn't answer any of the complaints that I raised.


    The POPLA site states that there is nothing else that I need to do as my appeal was successful.

    POPLA have been turning turtle on some favourable to motorists decisions when PPCs have complained. They are not so quick to roll over when motorists have complained about an unfavourable decision.

    Not saying this will happen in your case, but things aren't as black and white as I suspect you imagine. Money and power talks!

    When would you say is the best time to send your online appeal to POPLA? On the final day before the deadline (I believe this is the 28th working day but correct me if i'm wrong) or does it make little difference if I were to send the appeals tonight on the 5th working day?

    To answer your question quickly - depends on what your reasons are for holding back to the last minute.
