Entered onto wrong payment plan with capital one and auto defaulted

Hello,

A while back I was clawing myself out of debt, and im glad to say im now debt free apart from monthly living.

Anyhow I had a capital one account and I was 1 payment late so I called them and a payment plan was put in place. No different options were discussed. When the form came i filled it in and returned it.

I recently performed a credit check and the capital one account was defaulted. I called them and the manager checked with the data department who said I ticked the long term option. I presume it said short or long on a form, and I ticked long probably thinking give myself enough time to repay.

I've now found out that the short term is 6 months, and the long term was 9 months with a default placed on the account.

Ive asked management to get the telephone call transcript and asked for documention relating to what was sent and received.

Do I have any case or am I busted for ticking the wrong box

    What was the state of the account before the single missed payment?
    Why did you not just make the missed payment?
    Why did you go for the payment plan option?
    Did the form not explain things?

    I had it maybe 4-5 months and all was OK. But a better job came up.
    I was inbetween jobs.
    I was possibly going to miss 2 more payments.
    Difficult to assess now, but I wasn't aware there were 2 types.
