OH's MR has been turned down :mad:

I just need to know what to do next as I can't get my head round what I need to do. I'm so exhausted by this whole thing I can't think straight any more

Is it as simple as sending in the MR letter with a written letter saying why we disagree with their findings a bit like we did with the MR? Or is there a form I need to be completing?

Does anyone know how long it takes to get a hearing through?

I don't know how much more I can take of this I am at the end of my rope with the whole poxy process I'm even on the verge of telling them to stick their money where the sun don't shine

I wouldn't mind but OH is only sick because some t**t decided to drive on the wrong side of the bloody road and smash into him on a roundabout!!!!

Faith you need ties an ssc1 form to appeal and you should have 1 month to do this. Then I would seek help from a welfare rights organisation to help you with the appeal which will take a few months probably. Citizens advice may be able to help or you may have a law centre or welfare rights organisation that can help. If you can't get help you need to go through the pip descriptors line by line and work out exactly why your husband meets the criteria. I am assuming his claim was rejected on the question of the number of points not for any other reason. If you google pip appeal you may find online resources to help you with this. Good luck

Thank you the letter we received didn't mention that form so thank god I asked.

I know via OH's support group with headway that there is a benefits assistance team that have appointments twice a month so I'll ring them quick now. I had forgot all about them until you mentioned CAB

He is missing out by 2 points that's it but from what I put in the ME he should have picked up much more than that so fingers crossed. It's so annoying as they state he doesn't have memory issues yet he is having occupational therapy for it and seeing a neuropsychologist :mad:

This is the form you will need to appeal to the Tribunal Service (TS) after getting the MR decision from the DWP:

I would advise you to attend in person, your OH can then explain fully to the panel about the restrictions to their day-to-day life and their care needs.

Medical evidence (from your GP) will be very helpful at the tribunal.

If you can, get your GP to provide evidence relating to the relevant PIP activities / activities.

Do think about getting help from your CAB. They may have a benefits caseworker, who will be able to do a lot of the leg-work (such as writing to your GP for evidence, writing a submission to the TS) for you.

The Tribunal Service are very fair and very thorough.
