Sold a faulty computer

Hi guys,

I sold my 2nd hand computer on gumtree last month to someone for £50

a month after she brought it off me she has text me saying its stopped working, and the hard drive is faulty.

She is demanding some of the money back.

Im sorry, but this isn't my problem? It was working fine before I sold it, plus it was working ok for her for a month.

If you buy a car 2nd hand and after a month it breaks, you don't go back to who you brought it off, you take it to the garage.

What do I say?

I assume she paid cash and saw it working before purchase?

She has no rights. Unfortunate, but tough!

She paid £50 for a computer. I would just ignore her.

If she wanted a computer that came with a guarantee then she should have purchased one from a shop.

Provided that the one you sold was as described and you had the legal right to sell it then as soon as you have the money and the buyer has the computer, your legal obligations have ended.

Buyer beware, she took a 50 quid punt on clearly a second hand item, could have lasted 2 years or 2 days thems the breaks.
My OH always makes sure any adverts for second hand he places carry the warning, sold as seen, no warrenty given or implied.

If you are a private individual and did not sell the computer in course of a business (ie selling off old equipment) then the only stipulations are that the goods match its description and that you have the right to sell the goods in order for title to pass.

Goods being fit for purpose, of satisfactory quality etc only apply if you sold the goods in course of a business.

If you bought it from a private individual, then obviously you would have no rights if the car matched its description & they had the right to sell the car. But if you purchased it from a trader/someone acting in course of a business, then you would take it back to them as any fault that appears in the first 6 months after purchase is assumed to be inherent and its for the trader to prove otherwise.
