Car failed its MOT because of a bad repair.

I brought a 1999 Mazda MX-5 on 06/08/16, it was advertised with 12 months MOT but i have today had to get it MOT'd. It has failed on a seat belt anchor point has been inadequately repaired. I have called the trader i brought the car off and basically said I didn't ask for 12 months MOT to be put on it and he wasn't aware of the repair and then made an excuse that I shouldn't have taken it to a large dealership like Evans Halshaw for the MOT as they aren't used to seeing cars of that age. Before i take any action I just wanted to check if I am in line with the Consumer Rights Act 2015 to either get a repair or refund for the car due to it being a safety related issue.

this also makes no sense are you saying you went to buy a car and told the dealer "hey m8 i don't want your $hittie 12 mot on it just sell me the car"0 -
Sorry i mean't it was advertised with 12 Months MOT but there wasn't 12 months on it when i picked it up of which I knew at the time which in hind site was silly, when I called the trader earlier his reply was I didn't ask for 12 Months to be put on it. My understanding is if it's advertised as coming with 12 month MOT i shouldn't have to ask for it! But what it has failed on is the seat belt anchor point basically having a shody repair done to it which was obviously done before i brought the car, the MOT was carried out at my work at Evans Halshaw.0

An MOT test can be undertaken at any time.
Many councils require private hire cars to have an MOT which is no more than six months old.
For example, when applying for a Private Hire Vehicle Licence in London, an Mot must've been taken in the last 14 days - once the vehicle is just twelve months old.0 -
Ahh fair enough! A portion of my post is thus moot.
It is, however, interesting to see whether OP is acting as a business or a private buyer.
There's absolutely nothing to suggest this is a business purchase!
You seem to be over complicating things... quite simple, op bought car advertised with full mot, never asked the dealer to put a fresh one on so only had the remaining current mot, now has to mot and sees a bodge.0 -
So it did it or did it not have a brand new MOT when you bought it?
So the repair was done AFTER the previous MOT and visible to yourself when you inspected it and bought it?
