Date of parking 6 March 2011 - got another letter

Received a letter from BW Legal - "Letter of Claim". We have received numerous letters and NOT replied or telephoned about any of them. Date of Contravention 6 March 2011 - am I safe to just ignore this letter?

    Don't ignore this and be aware that this is pre POFA 2012 so they need to know who the driver is

    Do not phone them, they will put you under pressure.

    Tell us what the latest letter says especially threats etc

    We wrote to you recently that our client may shortly be instructing us to commence country court proceedings against you for recover of the above PCN and we also offered you a 40% discount. We are yet to receive payment and/or a response to our letter.

    Then it goes on about how to pay etc

    Not sure if it makes any difference but the driver doesn't live at this address anymore or still has the car.

    Hi,
    I got one of thesefrom BW Legal a couple of weeks ago for a pre pofa pcn.

    It is a form letter and ignores all everything that I have written before.

    It claims the £54, quotes Beavis, and tells me I will lose in court. and then later on says "In allowing you the opportunity to make representations and/or pay the Balance before proceedings being issued, our client has complied with the guidelines under the Independent Parking Committee Code of Practice (the code") and its obligations under the Civil Procedure Rules (CPR). All previous correspondence in this matter will be brought to the attention of the Court should this point be raised." and then "In the event we do not receive payment by (a date 14 days after letter received), we place you on notice that we will commence legal proceedings for the recovery of the Balance without further delay".

    I followed the advice in the Parking Boards Sticky and treated this a a Letter Before Claim and used the guidance the guidance there to write a reply telling them the notice is not compliant and they should write a compliant notice as is required of them. I am also composing another letter to the SRA.

    Well yes, the KEEPER (not the driver) needs to write back and state their current address and to deny liability and state a few home truths to BW Legal about this trash, not saying who might have been driving.

    To be fair to us volunteer posters, this exact issue and how to respond (and complain to the SRA and CSA and your MP and Mrs May) is covered all over the forum umpteen times already, search for 'BW Legal' and you will learn ten times more than you can expect to see posted yet again here. Also it's been covered a hundred times or more this summer on pepipoo forum!

    The linked pepipoo forum thread shown to you by The Deep shows an example SRA complaint, written by a legally-qualified person who knows the score v Parking firms. I posted it there as SchoolRunMum on pepipoo but I didn't write it. However you are welcome to use it (obviously making sure anything said actually is relevant to the letters you have had so far).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
