[Buyer] Delivered to Safe Place - lost case on eBay

Dear all,

I did not received the item, which I bought on eBay two weeks ago.
A seller sent it by Hermes and the tracking shows Delivered - Left in Safe Place.
I did not specified the safe place during the checkout on eBay.
I did not received a card, did not find the parcel around my house and my neighbours has not seen the parcel too.

When I asked the seller for a help with finding the parcel, he told that he has provided the tracking number to eBay and I am on my own.

I decided to open a INR case on eBay, which I lost :angry:

Could you please advise what should I do?

    You can appeal the case and ask ebay to review the safeplace comment. Your best bet really would have been to get the seller onside. As a seller myself, I know I will win a case like this but I also know some carriers don't leave parcels safely. I always ask the customer if they want me to dispute the parcel in instances like this. Ironically Hermes are one of the best carriers for disputes and almost always pay up, allowing me to refund.

    Try the seller again, ask them if they will help you dispute the parcel as Hermes won't let you do it.

    The seller has to work with the courier but some sellers aren't willing to. The OP doesn't say how they worded the message but if the seller just says the tracking shows delivered and tough, what are you suppose to do?

    It doesn't matter if you specify a safe place or not. Unless the sender pays extra for a signature then the courier will leave it in a safe place if possible. They get paid the same if they make one attempt or three attempts, so if they can do it first time then they will.

    Personally I'd make 100% sure that it wasn't delivered. I use My Hermes a lot and every case of non delivery claims when tracking shows delivered, eventually the recipient has found it or a neighbour has come round with it.

    I would check everywhere. I once had a parcel delivered by Amazon where somehow the courier had got through a locked gate (presumably by climbing over it) and then hidden it in a garden storage box. I would check every little of your property that is accessible. I would also double check to make sure you have your correct address on Ebay.

    If you still can not find it then your only hope is to do as theonlywayisup says and contact Ebay by phone and see if they will help.

    I would also suggest trying MyHErmes again on their Twitter feed or Facebook page. I've noticed on the Facebook page that they will talk to buyers on there with similar issues.

    They do > the seller. That's why it's always best to keep things amicable with the seller from the start. The relationship on eBay between buyer and seller can seem so strained at times especially as there is only email contact.
    If eBay were to simply pay out in a case like this, the seller can then also go and get compensation from the courier who can't legally prove delivery.

    I have lost an appeal on eBay, despite my case has been reported to the police.
    Seller was unhelpful, so I decided to open the case on Paypal... and I won :).

    Overall it was very unpleasant experience with eBay, so I will think twice before next shopping on eBay.

    So, really that was the correct result in this case for the reason that, the seller should have cooperated with you and taken it up with the courier who, at the end of the day, can't prove they had delivered it safely. The courier would have ended up compensating the seller.

    Unfortunately for you, it was a load of rigmarole to resolve.

    As a seller, we do have to think carefully about which courier to use, and I have changed minds sometimes. I have recently had Hermes status of "posted through letter box" on a medium parcel, and I've had two this week of Royal Mail signed for I've had to claim were not in fact received and didn't track / update.
