car insurance cat d

hi.does anyone knowif when selling a car you have toby law tell buyer it is cat d.or is it upto the buyer to find out.i am the buyer.thanks

    I think it really depends on the circumstances and how the seller represents the car

    If its been repaired fully and passed the safety check to be allowed back on the road then I doubt their would be a legal obligation to tell you

    If it wasnt and the seller deliberatly tried to hide it then maybe you'd have a case

    You would need to supply more detail though

    bought a ka for daughter 6months ago and she decided to get a new one went into a dealership who asked if she was part exchanging vehicle he did hpi check and told her it was reg cat d which she had no idea as when we bought the car chap said the wing had been repaired on the car but never said it was cat d so we are stuck what to do.

    Cat D means the car was written off but repairable

    Id imagine given someone was selling it and you managed to get it insured etc that it was repaired and passed the relevent checks.

    Given this happened then the seller doesnt have to tell you although they couldnt lie or misrepresent (i.e tell you it had never been crashed etc)

    As for the dealer etc Id be careful they dont rip you off, theres certainly nothing stopping them taking the car, selling it etc so if they claim otherwise Im guessing there just trying to knock down the value

    now a lot of people dont like write offs repaired or not so maybe it will be slightly less valuable but dont get ripped off because as long as its passed the checks its entirely legal to drive and sell
  • Category A: Total burnout. No value left in the vehicle
    Category B: Break only. Value lies in salvage
    Category C: Damage to car is more than total value of car
    Category D: Repair would cost almost as much as the vehicle is worth. Better to write off than repair. No comebacks for the insurers

    If you buy a car from a garage which has been written off, it's thier duty (by law) to inform you of this. If they don't tell you, you have the right to go back to them and get your money back.

    However, if you buy a car privatly, which has been written off, you don't have a leg to stand on as the law states that private buyers are aware of HPI checks being available!
