Ombudsman seems to be taking the side of capital one
Any help or suggestions?

A letter is judged as being received if the provider can supply details and the address is correct.
The FOS cannot overrule the timebar unless it finds the provider has done something wrong. So, its not taking sides.
If the FOS decide the barring is fair then its game over.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only.
