Smart parking PCN at Matalan Bury.

Hello.
I need a little bit of help and the newbie left me really confused.
I parked on a matalan car park on 24th September.
I purchased a two hour ticket and returned just over an hour later. As far as I was aware that was it. However I have received an email from leasing company today who told me they received a notice to keeper stating I didn't have a valid ticket. It appears I have purchased a ticket from the wrong machine. I went to in to matalan tonight to see if they could cancel the ticket. They have stated I have to appeal to smart parking.
My question is do I have the right to appeal it?

First things first, tell the leasing company you are dealing with this now.

As beamerguy points out, you need to email the lease company to tell them that you intend to challenge this charge.
Make it clear to the lease company that they must not attempt to pay the charge on your behalf and ask them to confirm that they have provided Smart with your details as the vehicle's hirer. If the lease company is a member of the BVRLA, they can do this electronically at minimal cost.
Smart will then reissue the Parking Charge to you as a Notice to Hirer. While you're waiting for this to arrive, check out the recent Smart threads on this Forum to see how easy it is for a hirer to beat Smart.0 -

The correct way ahead is as above, for the lease firm to say you were the hirer (NOT DRIVER!!) and they, the Lease firm, give your name & address to Smart Parking which discharges any liability they think they had...which they did not!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello. Thank you for your help. I work for the leasing company so I know they have passed in my details on to smart and they know I'm going to challenge it.
In reagards to the ticket machine - There is a large car park with metal posts down the middle to separate it. I parked next to the posts on the matalan side and went to the nearest machine but it appears this machine was nothing to do with matalan and was actually on the opposite side of the post and is run separately by bury council. It looks as though I have paid for parking in the wrong side of the posts! So confusing!0 -
I didn't purchase anything from matalan. I had my three children with me and they were driving me potty running round the store so I just dumped all my stuff and left before I murdered them all there and then. 😂0

OK so if the lease hire firm have provided your name and address as hirer, wait for the PCN to arrive in your name then use one of Edna Basher's examples of a first appeal from the hirer. It's a specific appeal, citing paragraph 13 and 14 of the POFA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You can post anything here as long as you don't give away any personal details such as VRN, real name, or (and this is sneaky) times from your PCN as the parking scammers often put unique times on a ticket so they can identify the motorist on here.
You must never, ever reveal who was driving, or say things like, I parked ... because the scammers will marry that to a post with your unique (fake) time and can then use that to say, you admitted that you were driving.I married my cousin.
