End of tenancy - emptying compost bin???

I have recently ended my tenancy in a privately rented house (through a managing agent). As part of the checkout report they have stipulated that the compost bin needed to be emptied (it was 5/6 full when we moved in, but unfortunately I have no definitive photos showing this.


Is this normal - given the idea of a compost bin is to use it for compost, it seems nonsensical to empty it?


Can this be classified as fair wear and tear? I just feel like I'm being made a mug of...

    Ignore. If a deposit deduction is proposed, dispute it.

    a) the bin was 5/6ths full at the start (it is for the landlord/agent to prove otherwise)
    b) the bin has been put to proper use

    Alternatively, send an invoice to the LL/agent for the value of the compost you have provided!
  • Genuinely not a wind up - I'm disputing it, but having been burned in the past by managing agents, I'm wary of challenging without knowing I'm definitely in the right.


    There is also a £70 fee for going down the resolution route...

    Not according to gov.uk there isn't.

    If there’s a dispute over a deposit
    Your tenancy deposit protection (TDP) scheme offers a free dispute resolution service if you disagree with your landlord about how much deposit should be returned.

    You don’t have to use the service but if you do, both you and the landlord have to agree to it. You’ll both be asked to provide evidence, and the decision made about your deposit will be final.
    All shall be well, and all shall be well, and all manner of things shall be well.

    Pedant alert - it's could have, not could of.

    Acquaint yourself with the facts on tenancy deposits. Managing agents and the like love to send out letters full of inaccuracies and threats, hoping that the tenants ignorance will lead them to blind acceptance of the contents.

  • I was in the same situation as yourself a few years ago. Landlady demanded we remove it or she would charge us for removing it. We never used it once during our tenancy, it was there when we arrived but she insisted that it wasn't. We paid her £25 to have her out of our lives. Our deposit hadn't been protected so couldn't use resolution, but I do know they can't charge you for this, make it clear to them that you know there is no charge for using deposit protection dispute.

    The exact phrase is:


    Should works to be carried out after checkout or compensation negotiated with the landlord to return


    the property to its former condition, subject to wear and tear, then a further checkout fee of £77


    (including VAT) will be charged to the tenant for the administration of the dispute, to be paid direct to


    the agent from the deposit held
