UKPC POPLA Letter - Paid with Parkmobile app

Hi all,

I would first like to say I have looked through the noobie thread but I don't seem to have found advice which fits my problem completely...short story is that I paid for the correct duration for the correct car and still got a ticket.
I paid using the Parkmobile app for the duration of my stay at a residential car park.

1. The Correct Location ID and Car Reg was used
2. I booked my car from

Aug 31 7:55pm - Sep 1 6:54AM costing me £4
Sep 1 6:54AM - Sep 1 7:51PM

Issue Time 12:33 1-9-2016
Time First Seen 12:33 1-9-2016

UKPC have given a Parking Charge based on "Park after the expiry of paid for time in a pay and display box". Clearly this is just wrong!

I appealed to UKPC directly showing a screen shot of my mobile phone payment via the Parkmobile APP.

UKPC replied:

Thank you for your recent correspondence in relation to the above Parking Charge.
We have investigated your appeal based on the information you have submitted and confirm that this Parking
Charge was correctly issued because there are sufficient signs at Ability Place warning drivers that should they park
their vehicle without displaying a valid Pay & Display ticket this will result in a Parking Charge being issued to the
vehicle.



Should I send the same information to POPLA, I paid and it's ridiculous. OR which parts of a legal letter should I look for?

e.g.

1. The alleged offence did not occur
2. Permission granted by tenant and landowner of flat
3. No authority to issue tickets
4. No legitimate interest in enforcing a charge – (Parking Eye vs Beavis Case not relevant)
5. No contract with driver due to Inadequate signage

The bad bits:

I did give them my name and address :(
I didn't wait 35 days
I didn't take any pictures :eek:
The pictures they took look like it was done using a fisheye lens to make the sign bigger / nearer to my car!

    Saying you paid, and providing proof is OK, but you need to back it up with signage saying that paying with a 'phone app is acceptable.
    Why did you decide to use the Parkmobile app? Did you know definitely that this method was permissible for the car park in question? It's a bit like booking a hotel through a booking.com type of website, then getting to the hotel and finding they only accept bookings direct through their own website or with the hotel front desk, if you see what I mean.
    Getting your own pictures of the signs will help if they do mention parking apps.

    You need to search the POPLA Decisions Sticky thread for the most recent successful PoPLA appeals, then use all the points available that are relevant.

    As already mentioned, getting pictures of the actual signs at the location in question is very useful as you should be able to pick lots of holes in it to support your PoPLA appeal.
    Watch out also for added credit card charges and prohibited premium rate 'phone numbers as well as tiny font size and signs hidden high up on poles or behind bushes.

    You also need to add, not the landowner to your appeal.

    Show us your draft POPLA appeal. Template POPLA points are near the end of POPLA Decisions, penultimate page based on my view of the forum (page 79 as I see it but I use an older green view of the board and might see more or less posts per page than newbies).

    Did you actually say who was driving though, giving your name & address IS required and isn't saying who was 'the driver'? Unless you chose 'driver' in the drop-down menu online to UKPC or said 'I parked' or similar.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
