Hi,

I have read the newbie post and think I understand the appeal template

however the advice I need please

I parked on double yellows in the car park (train station run by NCP)

Would an appeal not be frivolous? I did park on double yellow lines. I had paid the car park fee of £2.70 for the day so was covered to park...just not on yellows

Please help if you can

    Nope, not frivolous. A registered keeper cannot be held liable. So appeal as keeper.

  • thanks for the reply...I should have added that I paid for the car parking via a phon app (Ringo) which would have been paid through my debit card!

    Does that matter?

    Nope, we've seen all that before. You could have been a passenger in a car of four or five people!

    Remember, you are not 'telling the story of what happened' in a private parking ticket appeal. Hence the template appeal in the NEWBIES thread to stop people shooting themselves in the foot and naming the driver (my Goodness we've seen some awful ones).

  • ok thanks, last question. As the "fine" is £75 or £50 if paid within 14 days should I appeal before your recommended 3 weeks or maybe even ignore it until the next letter arrives?

    The size of the charge is not an influence on your decision - you WILL pay nothing.

    As this is a train station with applicable railway bylaws, and as POPLA have currently stayed all such cases and are not sure if they can make decisions (we think they should NOT be making decisions on byelaws cases and never had the authority):

    ...on balance right now, my advice would be to WAIT for the NTK. Then (as long as you are the keeper) appeal as 'keeper' using the template from the NEWBIES thread. The reason being, if POPLA decide they cannot hear byelaws cases any more then these cases will be in limbo.

    Luckily, real byelaws penalties time out after just SIX MONTHS so by waiting a month now, you are part of the way there.
