Cigarette Burn on carpet - how much deposit should I deduct?

    Well, why would it? I think whoever making that claim should be the one explaining why not inspecting regularly means the tenant is free to damage the property and to breach terms of his tenancy...

    I would not provide a carpet, people are 50 deep and desperate for a rental property.

  • I think Office of Fair Trading guidelines say that a 'no smoking' clause may be an unfair contract term as it infringes the tenant's right to quiet enjoyment of the property.

    If you really can't repair it then put a rug over it.
    A kind word lasts a minute, a skelped erse is sair for a day.

    But no-one would expect a rug over a cigarette burn to be sufficient in their own home - so why expect it for a place one is renting out? Anyway - the next tenant in the place would probably decide they don't like that particular rug and/or "don't do rugs" (that would be me then:)) and just hand it back to the landlord or put it somewhere safe for the duration of their tenancy. Followed by getting annoyed about the cigarette burn in the carpet.....

    I do know how selfish smokers can be - back from when I took lodgers in many years back now. I landed up with about 25% of my lodgers were smokers (though I had clearly put "no smoking" in the advert in the first place:mad:). Only one of the smokers respected my "no smoking" policy and that was my own home and I was living in it myself. The one smoker that did abide by it used to just take themselves out or for a quick "walk around the block" any time they wanted a fag and that was acceptable and we became friends.

    I don't think that this document mentions smoking. I also think that that definition of 'quiet enjoyment' would be quite liberal, to say the least.

    I wonder how the ADR deals with the issue of smell as clearly can't be demonstrated on paper! Smoke/pet smell can be quite damaging to a property so how do you ascertain the extent of it? Do you get certified statement from professional witnesses?

    That's when having the check out inspection carried out by a professional clerk is very useful.

    Only if the clerk is a non smoker though. Any non smoker can detect the slightest whiff - but smokers are inured to it and no longer know just how disgusting it is.

    My son bought a secondhand wooden fire place, a couple of years ago and could smell smoke on it for ages. Two years on, when I visit,I can still smell it slightly, being a non-smoker and not used to the smell because of living there.


    Regarding covering with a rug: The burn could be in a place where a rug would look odd or be a trip hazard.
