New Tenancy - Development next door

Hi Guys,

We moved into our new rented home on the first of this month. We are in a semi detached house and the land next door has bee a waste ground for over 10 years.

After signing the tenancy agreement the landlord got a letter from the developer asking permission to knock down the garden wall in order that a block of flats can be face up to the edge of the property so the the wall of the flats becomes the new garden wall.

The wall down the side of the our property is 14 high and stretches the full length of the garden from the back of the house. The developer has asked to knock down two thirds of the length of the wall and has also asked permission to erect scaffolding in the garden in order to build the flats. this equates to about 100-120 square foot of garden.

My partner and I feel that this renders the entire garden unsafe for us and the children to use for the duration of the build, which will be about 12 months. We are also worried that the new building site will attract unwanted attention from potential thieves etc and the wall being removed leaves our property open and vunerable to burglary if nothing is available is the building site for them to take.

The developer has visited the house and hinted that the wall is coming down whether or not permission is given to allow access for the scaffolding and also stated that it is possible to build the new wall from one side but not ideal.

Speaking to the landlord, he is unsure whether or not to give permission for developers to access garden.

The security of the property was a major factor for us in moving in here and that is now compromised. We will also be losing the use of the garden for a large proportion of the tenancy.

We are not sure what to do or where to seek advise. The little reading up I have done online hasn't been very helpful but I got the impression that some form of compensation needs to be paid by the developer to either us or the landlord for invconvenience caused. We have seen some of the letter the developer wrote to the landlord but there seemed to be some of it missing, I can only assume that bit that is missing relates to proposed compensation from the developer to the landlord. Nothing financial has been mentioned by either party to us as tenants and we are now tied into a tenancy agreement paying rent for a property that we will not have the full use of.

Any help, information and guidance would be greatly appreciated.
