Credit Card Chargeback

I have a bit of an issues with my credit card provider and a charge back. The charge back is to do with low cost holidays. I was looking to see if someone more knowledgeable or experienced can help.

In April we booked to go to Florida in September through low cost holidays. They obviously went bust but we had paid on a credit card so initiated a charge back for the cost of our transfer and accommodation as our flights were confirmed by United airlines. The charge back went through and we have been refunded for the accommodation and transfer we then re-booked accommodation and transfers expecting our flights to be fine. We were due to travel on the 17th September. We logged into United on the 15th August to do all the usual bits before flying to be greeted by a screen saying words to the effect that our itenary could not be viewed as the flights had been cancelled.

A 30 minute phone call established that low cost holidays had gone and cancelled our flights and the airline had refunded the near £2000 to low cost holidays on the 10th of September.

A further 3 hours phone call to united airlines followed where there was a lot of back and forth that the airline should not have allowed low cost holidays to cancel a flight where I was named as the lead passenger especially being that they had ceased trading some time before, we mentioned taking legal advice on the matter and they changed their views pretty quickly. The call ended up with us having new flights being booked by United airlines as 'complimentary flights' and they would 'get the money from low cost holidays' - their words. Our new flights were different flights to our agreement with low cost holidays and were an agreement between myself and United airlines.

Before this call took place we called the credit card company (15th August) to report the problem and they have acknowledged this call taking place. My wife has called 5 times more since to try and resolve this with no joy until today where she raised it as a complaint as it has taken 45 days to progress the issues.

So the situation in short is that we have paid £2000 to low cost holidays for flights A, Flights A were cancelled and refunded by United to Low cost holidays. United have sorted us with Flights B and have not been paid for them and have not got the money from Low cost holidays. Low cost have our £2000, United have sorted us flights as a separate and direct agreement with us. Flight A and Flight B were different flights at different times.

We asked our credit card company to complete a charge back for the remaining balance that we paid low cost holidays on the grounds that our agreement was not fulfilled by low cost holidays. They are saying that they don't need to as we got flights in the end. Our argument lies with the fact that low cost holiday has £2000 of our money, United have nothing and potentially could come after use for the cost in the future. Our flights ended up being a direct booking with United rather than the original booking through an intermediary.

Any idea where we stand? would it be an option to invoke Section 75 of the credit consumer act rather than trying to do it as a charge back?

Maybe I am being greedy but I really just don't want any of this to come back on my from United or for Low cost holidays to have £2000 of my money
