Redundancy criteria time limit

Is there a legal limit to how far a company can go back to use sickness as part of redundancy?


For example, if I was sick 2 years ago, will it be used? Or is there no limit and they can they can go back as far as they like?

    There is no limit. They can set whatever criteria they like, as long as it is equitable (i.e. everyone is treated the same way). There may be some leeway to treat some disability related absence differently, but they are by no means forced to. Pregnancy related illness must be discounted.
