    If a WTC only claim there must be a disability element to qualify.

    In my opinion they should pay it.

    The declaration is the patients responsibility, they shouldn't sign something if they don't know what it is. Just the same as someone shouldn't sign without reading it.

    Signing something when you don't understand it is a lack of care.

    Ignorance of the law wouldn't be sufficient as a valid defence.

    This is the form they signed it clearly states its not the dentists responsibility to check entitlement, it clearly states what type of benefits and tax credits count towards free dental treatment and it clearly states that every other type of form have to be valid, how can you say they don't understand what they need when its there in black and white, you say they receive tax credits then they must have sufficient understanding of English to be able to claim TCs therefore I fail to understand why you are now saying they don't have sufficient understanding of English to be able to read and understand a clear form with everything laid out and where its made clear that penalties can occur

    Oh and they are not thieving so and so's who only target -people who don't understand they target everyone who claims when they are not entitled to (even the scammers) that's their job.

    If English isn't their first language they should of got someone to translate the form to them.You cant
    just sign anything willy nilly not knowing the meaning of what you are signing. Expensive mistake I'd say.
