New Parking Eye Install, bought ticket during stay

Hi Everyone,

My sincere apologies if this is posted in the wrong place.

Quick points:

- ParkingEye PCN issued by post
- New P.E system (installed that week/week before)
- I regularly travel to location, this was the first time with the new ANPR system.
- Bought a ticket for 1 hour, 53 minutes into my stay, then promptly left

Do I stand a chance at appealing POPLA? Can anyone advise on what grounds there could potentially be success?

    Does the PCN have wording near the bottom (front) saying the 'registered keeper will be liable' under the POFA 2012 after 29 days?

    Sounds like your ticket covers the hour the car was parked for. Attach a copy of that ticket to an online appeal - NOT SAYING WHO WAS DRIVING. Example template appeal is in the NEWBIES FAQs thread near the top of this board, adapt that.

    - It says "The parking charge is now payable to ParkingEye (as the creditor), by the driver. No mention of POFA or POFA 2012.
    Sounds like your ticket covers the hour the car was parked for
    - I bought upon leaving, so perhaps not? I arrived, stayed 53 minutes, came back, bought a 1 hour ticket and left 2 mins later.

    Good, so can you confirm then that your PCN has a blank white space at the bottom like a paragraph might be missing, and that the PCN was posted more than 14 days after the event?

    If so, you are laughing as long as the registered keeper appeals (not the driver).

    OK and at POPLA stage come back because we have examples of POPLA wording which will nail this (much longer legal stuff). Be very very careful with wording in the first appeal, not to imply who was driving and if they write & ask, ignore that letter/email.

    You can use the Blue Writing appeal in the NEWBIES thread and attach (online) proof of paying (but don't blow it by saying 'I paid'!).
