This is likely to be correct.If she took it out before 2005 they can still refuse it because they weren't regulated.
Just FYI
The way it works is the FOS will look at who the original seller was and whether THEY were under the jurisdiction of FOS or one of its specified predecessors at the time.
Santander is essentially what was Abbey National Building Society which was under the Building Societies' Ombudsman scheme from about 1987 but if you bought through somebody that Santander subsequently took over, it would depend on whether that somebody was a member of a scheme at the time - the takeover transfers an already existing jurisdiction/liability but does not create one.0 -
