Get this cancelled by the landholder or have an appeal upheld by POPLA, otherwise there'll be 3 further Ryder Cups for you to watch before this is 'dead'. They have 6 years to pursue you. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

PP are so stupid not to have amended their NK wording re the 'POFA 29 days/driver details' as they are doomed to fail every time a forumite appeals as keeper! Their desperate letter asking who the driver was is always a source of amusement too.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have asked PP for a POPLA code. I am sure that I will win at POPLA; otherwise I will just ignore their silly threatagrams lol.0

They have responded by not supplying a POPLA code and insisting that I supply the driver's name and address within 2 weeks.
I assume that I just ignore and wait for them to supply a POPLA code. They probably won't.
Can I escalate to the BPA if they don't supply a POPLA code and when should I do this ?
Please advise.0 -
the BPA will say they have replied and are simply asking for more info , bide your time , you have responded correctly , do not reply , await a POPLa code , if it does not appear then contact the BPASave a Rachael

This is the latest wheeze by the scammers asking who was driving ?
They can insist as much as they like ...... SO ignore them and wait for the POPLA code. If they don't offer the code then complain to the BPA0 -
In a memo to all BPA operators, this is what the BPA told them:“the following practices may be considered as Code breaches and must not be continued:
• Asking the motorist to enter into additional correspondence to obtain a POPLA code
• Failing to include a correct and/or valid POPLA Code within the Rejection correspondence
• Issuing a POPLA Code with a date identifier which is significantly different from the date of rejection
• Appearing to indicate that the issue of a POPLA Code is conditional on driver details being supplied “
Use that quote in any complaint to the BPA.
I understand that the BPA were instructed by the DVLA to send this memo to operators, so in any complaint to the BPA quoting the above, make sure you send a copy to the DVLA.Please note, we are not a legal advice forum. But quoting back their own instructions might just stop the gobby bird from firing some off-the-cuff fob-off line.
Copying it to the DVLA might cause them to ask a question of the BPA.
BPA sanctions, while as rare as hens' teeth, tend to be given to the small fry providers, so the small bullies are more open to bullying by the BPA, but who are not brave enough to bully the very big bullies! Bully for them! 🐂Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front.
