liability dispute, no legal cover and excess

I was involved in accident and I think the other driver is liable whilst he says it is me. So currently that is under dispute and the insurance company are investigating the claim. I don't have legal cover so if it does come out as the party is liable will I still have to pay the excess?

yeah I've put in a claim saying it was the other driver's fault so the companies are going to assess who they think is at fault after checking the details as it happened at a roundabout and involved lanes. I'm insured with esure0

Without witnesses it'll probably go 50/50

Legal cover with a motor policy isn't for fighting liability.
Your insurer deals with the liability issue
When you claim off your own policy for damage to your own car you normally always pay your excess which isn't covered by your policy.
If the third party's held liable or partly liable you can then pursue the third party to reimburse you. (If this ends as split liability you get back your proportion - 50/50 would mean you will get half back)0
