If the bill is being picked up by your insurer, this isn't your call to make. As your insurer is picking up the tab for this they get to choose whether or not to admit liability and how the case is run. If you admit liability that will be a breach of your insurance policy and may invalidate your insurance.

Good point how do i find out what is expected of me? I have check my policy documents it doesn't mention going to court.

It does state that I need to take all reasonable steps to help them fight a case at my own expensive, but it doesn't state what it class as 'reasonable'

To me reasonable would to turn up at my local court NOT one two hours away! (issue being that on google maps it will show up a 1hr 20mins but this does not take into account you are going into a city centre need to use park and ride+bus etc.

Silly question perhaps, but have you telephoned the court office , explaining your circumstances and asked to change court.

Sorry if I missed something and you have tried this.
My only experience of county court was a few years ago and my case was set down to be heard at a court a distance from me and I contacted the court and managed to get it changed.
  • Reasonable steps with helping them fight a case would include attending court I think.

Does it say at 'your expense'? I would have expected the insurer to pay to be honest. Ask their solicitor to confirm whether you will be paid travelling costs and childcare and see what they say.

I think 2 hours each way is reasonable for a one-off hearing. I commute an hour each way every day, for awhile did it 2 hours each way, lots of others do the same. However you should make the insurer's solicitor aware of any time constraints you have around childcare etc. so that they can plan accordingly.

Very true whats reasonable for one isn't to another. I wouldn't do a job with an hour commute each way, but like you say plenty of people do. It would be perfectly reasonable for me if I didn't have the childcare issues. i will speak to the solicitors again to see what they say then put it in writing.

    Thanks

I haven't contacted the court direct as I have been doing everything through the solicitor, not sure if I am allowed to contact them direct seeing as it isn't really my case, the case is insurance company v insurance company.

Rather than using park and ride (which can be slow), can you drive to a station outside the city and take the train in from there?

Oh thats a good suggestion ,thank you,

I will investigate where the nearest stations are and how far the station is from the court.

EDIT: just checked its only a mile from station to court I can walk that, thank you so much I would never have thought of that suggestion. Will be quicker and less stressful. Just need to find which station to drive to now.
