ES parking enforcement member of BPA?

Options
Hi everyone,

So I know parking tickets are common but I got my 1st last night and it's really upset me.
I pay every single week but I don't know what happened I got mixed up with my days and didn't get a new week.
It is a private car park called ES parking enforcement and it does say they will contact the DVLA for your information but I can't see anywhere if it's a member of the BPA (It is my understanding they need to be a member of this to get your details?)
Anyway I was wondering if anyone knew if they can do this?

I plan on not paying under the grounds that £100 is unreasonable and they have not lost this amount by my being there.
I will be sending a cheque to cover the cost of my parking there for they day and sending a copy of all the tickets I have bought over the last 6 months to show I always pay and they get a hell of alot of business off me.

If anyone has had any similar experience with this if love to know the outcome!

Thank you

    STOP!

Don't do anything until you have read the Sticky thread for NEWBIES.

Thirty seconds searching the internet tells me they are IPC members so you need to send the IPC template from the NEWBIES thread.

You then need to decide what your options are after that. Certainly do NOT send them any money.

After sending the initial template your options are ignore anything and everything you get for the next six years unless you get real court papers, or make an IAS appeal to their kangaroo court then ignore anything and everything you get for the next six years.

This assumes neither you or the event are in Scotland or NI where the law is different.

  • Hi there,

Thank you for the reply I will read what has been advised.

Yeah I saw about the IPC when I was researching but I assumed this was something different to the BPA.

So should I not even said any money covering the days parking I didn't pay for? I read somewhere that this makes you look reasonable?

    Thank you,
    Zoe.

The IPC is something different to the BPA. It's a much worserer trade association.

Sending any money will be taken as an admission of guilt, they will still want the 100 quid and more besides, and you may give away the driver's details if you aren't careful.

Just follow the script and send the IPC template from the NEWIES thread. Copy and paste. Don't edit it.

Again, I assume you or the alleged event are not in Scotland or NI. It is important.

No, and you'd be in danger of saying 'parking I didn't pay for' which not only admits not paying but also admits who was (probably) driving. Not good, stick with the plan.

DO NOT try IAS stage though - the reason why not is in post #3 of the NEWBIES FAQs.

  • Thanks everyone.
I need to have a proper sit down to read the post fully.
I am considering just paying the 60 quid though, I'm scared it wI'll end up with me paying 100 plus in the long term if it goes as far as court and I don't know if I can deal with the stress of it.

Which is exactly the effect the PPC wants. You taking what you think is the 'easy option', undoubtedly enriches a small-fry operator, encourages him to issue more tickets to the old, vulnerable and those for whom £60 is a weekly shop.

If you feel that's right, then no one here will try to stop you, but we're here to help those who want to fight this scourge on motorists, with more and more one-man-band chancers jumping on the gravy train looking to extort money, spurred on to issue more tickets by those willing to pay up without a whimper.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Even if it did end up in court, (not very likely), it is unlikely that a judge would make you pay £100 for a minor human error, especially as it is likely that you would get off a council fime.

If you cannot cope with the "stress" of dealing with these clowns, heaven help you if you were faced with a major crises. Man up madam.
