A claim or not a claim?

I'm about to get a new year's car insurance, and I'm a bit confused by the terminology.

Someone drove into my car and wrote it off. Their insurance company gave me a cheque for the value of the car.

My question is - who made the claim? Was it me or the person at fault?

I *think* I'm right in saying that I have not made any claims (i.e. they made the claim to their insurance company for the damage done to my car).

Or did I make a claim, but it was a no fault claim? Or is a "no fault" claim where the parties agree neither was at fault?:think:

    You were involved in a claim, but it's a no-fault claim.
  • You need to notify them of claims and any accidents or incidents even where no claim was made. If you fail to declare you risk having your insurance cancelled.
