Missing POPLA appeal

hi,

Can anyone help ? I have appealed to APCOA parking and my appeal was unsurprising rejected.

In the reply to me not being successful the letter stated that I could still appeal to POPLA within 28 days of the letter being sent and dated.

The letter was sent to my old address and in that time the 28 days for the appeal to POPLA has expired. I have tired the online appeal but I can't proceed.

Because I moved and changed address the letter was sent to my old address and the 28 days expired. I have proof that I changed my address just before they sent the letter.

Any ideas of what I can do next ? do i write to APCOA and state that they sent the letter to the wrong address and I need a new number for POPLA appeal or just ignore the letter or pay the fine ?

Any info/help would be fantastic.

    was it a windscreen ticket or one done by ANPR?


    was your appeal done by email or by letter to them ?

  • The ticket was issued at Luton airport. I did the own investigation and I found that the picture was done with a mobile camera on a smart car. The car with the camera wasn't visible and hid behind signs.
    I appeal to them by email.
    I was expecting an answer by email but got a letter which was then sent to my old address and this surprised me.
    I have changed the V5 document to my new address but as stated earlier the reply letter was sent to my old address and I only manged to get hold of it today.

    1: Luton airport probably comes under land that is covered by bylaws , as such POPLa have all cases on hold awaiting a decision as to sutability of offering appeals


    2: as the "deed" was done by ANPR (man with camera in van is disputable?) they have to apply for your details within 14 days of the incident


    please tell us the date of the incident , then pull out your V5 and look at the date (inside left page , second row from bottom) called DOC ref , what is that date?

  • Looking at the 1st letter I received that letter is dated the 19/7/16 and the incident happened on the 22.6.16.

    The address was updated on the V5 on 22.8.16.

    The answer for my appeal was dated the 22.8.16 too and sent to my old address.

    parking companies are only able to get your info once from the DVLA , they did this within 14 days of the incident , did you not instigate mail forwarding?

    so they have failed to abide by POFa2012 to pursue the owner as it seems the letter was received 28 days after the incident


    contact the BPA and inform them that the company took 28 days to contact you and in that time you had changed addresses


    TELL THEM to get the parking Co to issue a POPLa code

  • I didn't have royal mail forwarding from ym old address to my new address.

    the incident happened on the 22.6.16 at luton airport.
    the 1st parking charge notice was sent 19/07/16.

    I appealed the parking charge notice on the 8/8/16 and APCOA parking responded to my appeal my letter and this letter was sent firstly to my old address and was dated the 22.8.16
    ? when I received it at my old address and in between the 8/8/16 and 22/8/16 I changed address and my V5 states that it was changed on the 22.8.

    Are there anymore avenues that I could explore to repeal, just pay them or just wait and see what happens ?

    Do you think I should contact BPA and see if I can get them involved ?

    If you didn't get a PoPLA code with the rejection letter after your initial appeal, do as pg has said and complain to the BPA that you didn't get a PoPLA code.
    In addition state that the rejection letter has failed to to transfer liability to the keeper.
    Send a copy of your complaint to APCOA.

    If you get anything further from APCOA without a PoPLA code, complain to the BPA again. Keep doing this until you get a code. Do not respond to the PPC, only to the BPA until you have a code.
