Im sorry I haven't been around much - worked last night and have to go in again in half an hour - I haven't been able to catch up, since yesterday, so will 'speed read' the last 8 pages, but if I don't post till tomorrow, please don't think I've abandoned the thread.
I am still 'gutted' at the outcome - are there any 'positive' vibes yet?

Hi all, MOT seems 'dammed if she does and dammed if she doesn't'. All morning have been wracking my brain to come up with suggestions but feel useless. I soo want her and her children to get a more positive course of action.
I can't believe they would think this support is a result of a 'blog' and am quite insulted to bein this country that this could be suggested.
I have always thought as a nation we are better than that, obviously not.
However, we mustn't lose sight that MOT and her twins are the people that matter, it is easy to get distracted by discussing blame etc. What we need are ways to get the message accross that THIS LADY NEEDS HELP!!!! (shouting this at those council people who may read this).

Floss do you think it would help if we e-mailed or rang the council responsible for this situation to explain our genuine disgust, I would hate to make things worse but feel useless sitting here when eviction day for MOT looms.

  • The housing situation in this country is a disgrace how many of us sitting in debt are one or two paychecks away from being in MoT s situation. I know when we considered going bankrupt we put our names on our local housing list, years later we are still on the list somewhere. I fail to understand their ideas of priority and homelessness.
This situation will get sorted the only way is up.

    Hi Sasp,

    No that wouldn't achieve anything.

Any further appeal HAS to be on a point of law - not just on public outrage ;)

    Hi floss,

Thanks for clearing that up for me, I was not sure. I appreciate that the thread is long, I have been reading it - when I was first pointed to it I sat and read through the first 70 pages in one afternoon but it is hard to keep track at times when so much stuff is crammed into one space.

Do you know how many points she has now - this could have changed when she moved into the place she is now and she should have called them to make them aware as they are different departments (here). Sorry, I am just trying to help the best way I can so if this has been covered then I apologise, but I was trying to establish (using my own situation) why she did not get the points, or maybe she was not aware of how to get the points so this could have been why.

I know housing is short but houses become available every day/week so if she had enough points then would have been eligable (my friend works for a HA and she told me that houses come available every day and some sit empty for 3 months to a year as some people can't be bothered to do the paperwork!!). This is why I figured she might not be on the housing register if she had not been offered anything in the last 3 months.

If this is the case and they are refusing to let her have permanant housing then only think I can think of that is that she has been deferred because of the arrears (did her landlord try and get these back?)
http://www.dacorum.gov.uk/pdf/HOUSINGREGISTERPOLICY.pdf and I don;t know what else to suggest, sorry. I know everyone else has already covered everyone but because I have been doing the same thing every day for the last 2 months I thought I would see if I had information that someone might have missed along the way.

All of the policies and points are there (sorry again if already posted) I AM just trying to help, but I cannot understand why they would not give her points for the situation she was in unless they have deferred her (it's in section 2) - because we are in the very same situation as MoT (court application going in on 3rd Feb) then I have been making sure the council gives us all we are entitled to and I know you have to push and push to get what you are entitled to.

IT is right, and it states in the link above that priority is given to prisoners and the like, I said this in my own post that normal UK Taxpayers come the bottom of the list with scroungers getting first priority, someone hits a bump in the road and it's there fault, but if you have never worked, spend time in prison or contribute to 'society' in general then the council stand there offering you the keys of a nice shiny new house.

I don't know what else to suggest then tbh, she needs to check that she has been given the points that she is entitled to and then if she has enough she has to ring in, every day, maybe the council will have details of a B&B that will allow her to stay and also claim HB to pay for it, or another LL that will give a short term let. In theory, the less space she has to live in the more points she will get to get to the top of the list. is there a caravan site nearby that she can enquire as to whether ther eis an empty van she can rent for now.

Ah, this situation stinks, I really don't have anything else I can offer advice wise. I am sorry if I offended anyone by asking the questions or posting the details that I was aware of, it was not my intention, jst trying to cover all angles really. I had not read MoT was on the register for housing, just that she went to the homeless department and going to the homeless deprtment does not get you on the register around here, it gets you into somewhere to live temporarily then you go on the register but if you don't have enough points they will give you x days and tell you to find a place of your own. I guess they are all different. It was my intention to help with the only experiences I have, I admit it is not a lot so apologise if anyone was offended by my posts. I was just trying to help and to epxlain how it stands for me, and this is why I mentioned it.

Sorry. Good luck MoT, I hope you can get something sorted and have a big hug all round. I don't know what else to say (still shaking my head in disbelief)

You do sound confused so hope this will simplify things as you are facing the same position.

there are two ways into social housing
    1) via the allocation list -open to everybody and you are given preferance dependant on your situation. it takes a long time to get anything this way.

    2) VIA A HOMELESS APP -open to applicants who are eligible, homeless, in priority need, not intentionally homeless and have a local connection to the area that they applied to.

IF you make an app for homeless !!! and are accepted for a full duty you will have priority over everybody on the normal register and the local authority will accommodate you until they can find you something.

If after investigations into a homeless app the local authority find you to be not in priority need or intentionally homeless they do not have to accommodate you , you will not be awarded extra points but you will be still eligible for housing under the normal housing register (point 1).

With regards to your suggestion of living in a caravan in a garden, you would need to get planning permission to be allowed to do this , failiure to do so could result in an eviction order being granted and the caravan being removed after the necessary process has been followed of course.

Hope this makes tha t process a little clearer for you. I have read your thread and i seem to remember you are renting from your mother and there is no issues of rent arrears so hopefully you wont face the same issues.
