thats awful!!! It concerns me that they are still fixing a date for the eviction, it is almost asthough they are treating it as carte blanche that you are going to be evicted. all i'd say is if the worst does come to the worst (and with the support you are receiving it had better blooming not do!) then you can't reasonably be expected to deal with all that in one day, so refuse to hoof it until the next day. Big hugs hon, hope it goes well later. xxx

I'm sure this'll be because the LA is convinced that MOT's case has been assessed correctly. When we have an MP's enquiry or an appeal at work we are very through, we check everything. I wouldn't be surprised if MOTs file has already been reviewed by a senior manager. In my LA if we have any bad press the chief exec will ask for a thorough review of the situation and on occasion will direct us to change our original decision.

MOT I would urge you to sort out your Plan C now, I know I'm being negative again but where I work only a small proportion of appeals/reviews are successful.

Heard from solicitor just before I left for Chiro's - appeal date is 3rd Jan AND so is the eviction date - how the hell is that going to work?? I'm now all down again as I just can't imagine how, if the appeal fails, I a) I can move out the same day b) how will the twins cope with all that in one day c) how will I find somewhere private when a lot of private lettings places are closed or if they are open then I have already made plans to 'get away from it all' for a few days to a friends up north d) oh I can't remember .........mind not thinking straight again!

First of all DON'T PANIC!! I know the timing is awful but it's much better than 1 wk before xmas.

    a) be prepared and you will be able to manage this especially as most of your stuff is already in storage.
    b) don't worry the twins will cope, children are surprisingly adaptable.
    c) sorry but I think you need to put your plans on hold or could I-T put you up for a week?

Like many others, I'm still following this thread and waiting to see if there's any positive news yet. I'm sorry I can't add any practical advice as to how to deal with these council officials. The publicity seems to have made them even more hard-nosed and arrogant
What they are putting MoT thru just beggars belief! All she asks is for a home for her and her kids.

I can't offer any practical advice either, but I am blo*dy fuming at the fact MOT has been given an appeal and eviction date of the 3rd of January.

That council needs to wake up and smell the coffee, this is a real person you are dealing with here, how can you sleep at night?

Hi mot, and everybody - I've just been 'catching up' on the thread. I have mixed feelings regarding the postponement of the appeal; on one hand it is, seriously, good that you are at least able to spend Christmas without the turmoil of living out of suitcases, but, on the other hand, the cynic in me can not help but think that there is an element of 'burying bad news' as the publicity that will be generated, just a week after Christmas, will be nothing compared to a week before Christmas.
I am, genuinely, pleased that the pressure appears to be having some, if limited, effect on the council, although - again the natural cynic - I think we can be forgiven for wondering how much of that is a 'back-covering' excercise.
I also find it difficult to come to terms with the fact that both appeal and eviction have been set for the same date - does this mean that mot must expect to retirn from the appeal to find her belongings stacked on the pavement?:confused:
Are there any figures available to show the number of new council homes that 'Dacorum' have let out in 2007, and how this compares with previous years? I'm just trying to fathom out their apparent agenda.

MOT, when you next see "your solicitor" could you ask the specific question of whether the council would have to go to court and get an eviction order and then go back to court to get baliffs appointed?

I know we have discussed that your tenancy is not as secure as an AST, but I would like to know who can physically evict you. I can't see a council admin person having the authority or it being within their job description (think health and safety) to physically remove you from the property.

Separate from the gratitude Ms Davis's support group feel after yesterday's timely intervention, this post indicates what even the slight 'relief' of the 17-day Adjournment is doing to Ms Davis.

ampersand, sorry for the late reply. The answer of course is yes, for what it's worth. However I would prefer my name to be removed or changed if that's ok.
  • Hi MOT
Hope things went ok for you today.
It is a bit concerning that the hearing date and eviction date is the same day, but they now know that you are a fighter and have a lot of people on your side and will not give up without one hell of a fight.
As for Adam, kids will always find something to bully another kid about (mine was for having ginger hair, which is why i am now blonde!!) but at least you know your children are mature, sensitive and have compassion for other people (and in a few years time girls will be queuing up to go out with a lad like that! )
