NTK 5 months after initial ticket and appeal - advice please!

Hi all,

I received a PCN from UKPS Ltd on 22 Apr 16 for the amount of £100 (or £60 if paid within 2 weeks); I was shocked by the amount for less than an hour of unpaid parking which led me to do some research and from what I could tell the charge should be representative of the parking provider's loss of earnings from your parking infringement.

I therefore wrote to them using a template I found online (pasted below with personal details omitted):

UKPS Parking Enforcement Company, Appeals and Payments Department Central Office, the Hangars, Harbury Lane, Leamington Spa, Warwickshire, CV33 9SA.

Dear Sir or Madam,

WITHOUT PREJUDICE

Ticket number: XXXXXXXXX
Vehicle registration number: XXXXXXX

You issued a parking ticket XXXXXX on 22 April 2016 but I believe it was unfairly issued as an unenforceable penalty that does not represent the landowner’s actual losses. This letter does not constitute me accepting any form of liability for the parking charge. I will not be paying your demand for payment for the following reason:

The charge is disproportionate and not commercially justifiable; the amount you have charged is not based upon any commercially justifiable loss to your company or the landowner. In this case, the £100 (reduced to £60 if paid within 2 weeks of issue) charge you are asking for far exceeds the cost to the landowner’s of up to 1 hour of parking for £1.10. The vehicle with registration XXXXX was not parked there for more than 90 hours to justify a charge of £100. The amount you are asking for is excessive.

I hereby tender £10 in full settlement. (Cheque enclosed).
If you choose to pursue me please be aware that I will not enter into any correspondence and this will be the only letter you will receive from me.

The cheque was not cashed and I did not receive any correspondence from them until recently I received a 'Notice To Keeper' dated 15 Sept 16 (almost 5 months later!) calling for me to pay £100 immediately or a Debt Recovery Agent will take it further demanding £150 in the first instance and leading to court proceedings.

Point to note the car in question is not mine and is a courtesy car from a garage working on my own vehicle. Further to this my surname on the NTK is spelled incorrectly (by one letter) and the postal town on the address is also misspelled (by one letter).

Can anyone advise me as to what course of action I should take? Should I cough up the £100? Return the NTK with 'no one by this name at this address' or any other course of action?

    I assume the garage got an earlier 'NTK' and gave your name and address as the hirer, hence the minor typos. They mean nowt.

    Do not return the NTK 'unknown' or the parking firm will revert back to the garage who might get spooked about possible court and demand you pay it.

    You can send an appeal to that NTK, calling yourself the 'hirer' of the courtesy car. Do not use the rubbishy one you found above, it's hopelessly out of date to be talking about the charge being extortionate and not related to any loss. That went out of the window in 2015.

    Use a version written by Edna Basher on here, have a look through the forum, you need a strong challenge from a hirer, not giving away the driver.
