    IVA and PPI are not black and white like bankruptcy.

    Some companies will offset, some won't, some will refund the interest, some won't.

    You might get more luck asking on the Bankruptcy/IVA board, but like I said, there are no absolute rules for an IVA.

  • Just an update on my claims


    Sent a letter to Capital regarding the £900 and for them to show evidence of the redress. The reply was that they never miss sold me PPI in the first place.


    Chain of events
    1) Phone up inquiring if I had PPI, Answer was yes
    2) Sent off PPI claim form, Answer was I was miss sold and awarded me £900
    3) One week later got letter saying that they are not sending the £900 but keeping it as a redress
    4) I send a letter asking them to prove the redress
    5) Received a letter saying that they have not miss sold PPI


    So they have said yes to miss sold, dangled a carrot in front of me then moved the carrot further away and then said that the carrot was not there in the first place.


    Barclays said no to the Barclaycard however I also had a loan with them and they have said yes to miss sold but was expecting them to withhold as a redress due to the old IVA but have paid out.


    The advice I got when I first posted was that the creditors are in there right to use any claims as a redress (which I agree to) however I have made 4 claims (2 Barclays) all of them was in the IVA. 2 have paid out. 1 said no miss sold and the other cannot make their mind up.


    With YB and Barclays admitting miss sold and paying me out are the rules with redress the same in 2002 as they are today, or is it like what dunstonh said that some are better at keeping records


    My advice to anybody in the same situation is give it a go. (rightly or wrongly)

    You seem to be confusing the terms "redress" and "offset".

    If you are willing to borrow money, not pay it back and then demand more money from the firm you didn't pay back then don't use a CMC to do it as the firm are within their rights to offset the money against unpaid debts and the CMC will bill you for the full amount even if you don't see a penny
