Have this naive group of Councillors thought this thing through? For a start, have they thought how PE are going to finance this deal. Are the council paying them a fixed sum or are PE relying on their fake fines to make a profit?

If the latter, then PE have every incentive to "fine" everyone, even those on that supposed "white list".

I thought councils (even when using a third party) are not allowed to use ANPR cameras?

3-4 hrs at the start , as PE realise they are making a low income , then this will be reduced to 2 hrs , then 90 mins then 1 hr 20 mins and end up within 2 yrs at 1 hr 10 mins


exactly the same as they have done with many Aldi car parks

Naive YES unless they are getting some of the action. ££££

This Parish Council have no idea how this will hit them once PE move in. Then the complaints start rolling in, by then they will have signed their life away to the devil on a contract that will be very expensive to break.

Much cheaper to put in pay and display machines than suffer the wrath of the locals.
Let's face it, nobody can be more a rogue parking company than Parking Eye.

SOMEBODY MUST WARN THIS PARISH COUNCIL NOT TO USE PARKING EYE OR ANY SIMILAR COMPANY ... DOING SO AT PERIL

And the paper says ...

Is the Parish that stupid to believe that ????

I can't find any search results showing that this was ever done.

A parish council is treated in local government terms just as any borough or district so this council should not go down this route.
Never mind the angst it will cause in the local community.

With regards to your FOI request:-

1. Could you please inform me on what basis a motorist could be liable to prosecution (as stated on the ticket) for failing to pay and display? – The statement that you are referring to is pre-printed on the ticket stock by the manufacturer. The Parish Council do not have tickets made specifically for their use, as this would significantly increase the costs of the tickets; and we feel that the funds would be better spent elsewhere. The use of the word ‘may’ enables their use in all settings. The Parish Council do not ‘prosecute’ for failing to Pay & Display. Parking Enforcement is carried out by Athens Security Services Ltd trading as AS Parking under contract law in their own name as the creditor and principle.
2. Are there any Byelaws or Parking Place Orders applicable to this car park, and if so could you kindly provide a copy thereof or advise where they may be found online? – There are no Parking Place Orders or Byelaws for this car park.

Councils cannot use ANPR (nor get round it by getting a private firm to use ANPR) and cannot operate their car parks as if they are private land, as per Robert Goodwill's letter.

Someone should point this Parish Council towards talking to:

- High Wycombe Council, who are currently banned from getting DVLA data after trying to run their car parks with ANPR and being reported to the DVLA for it.

- Horsham Council, who spent a fortune (I think) on ANPR cameras in their 'Forum' and 'Swan Walk' car parks then realised they are unable to use them to get DVLA data. They have reverted to stopping random drivers months later and trying to hit them for missed tariffs, all stacked up against them as if the driver is liable (the signs are woeful and as they neither fall under POPLA nor the TPT, no-one is inspecting the signs which is unacceptable - also what if a car has just changed hands?!):

Maybe someone should give Cllr Richard Izard (Chair of the Parish council concerned) a call on 01962 712167 to make him fully aware of the s**t the PC is about to land itself in.

Btw, Councils can use ANPR systems in their carparks. Essex County Council runs the Park & Ride in Colchester and uses ANPR to allow it to operate a pre-paid weekly/monthly ticket system on top of the normal daily pay and walk away users (you have to enter your reg number when paying for parking. This then shows you a photo of your vehicle so you know it is for the correct one).

The idea works well as when the local football team play at home, people can park and if running late, pay on return to the carpark (its a fixed price all day). Any cars that leave without paying get a fine through the post.
