You need do nothing except acknowledge the service of the claim online on MCOL using the password (not completing paper forms), ticking that you will DEFEND IN FULL (do not contest jurisdiction).

That buys you 28 days from service of the court papers, almost a month to decide how to play this...really, no need to panic.

You can defend on SEVERAL points like everyone else here (one point is the fact that they cannot show who was driving). You will find loads of examples and will have plenty of time to perfect it.

And if this then actually goes to a hearing (court papers DO NOT mean a hearing is inevitable!) if it all gets too much you could settle even on the day before/on the day of a hearing, you know. We are not forcing you into a road that means you'll have to definitely attend court, by any means - but we are helping you fight back to the extent that you will get time to fight this and a chance to win, if you feel up to the hearing.

    If it happens.

Cases do get discontinued by claimants but unless you defend you will never know. Nothing to lose, may as well fight it at this stage and complain to the SRA and CSA too, about the misleading words thrown at you by BW Legal. They are being investigated, we know that for a fact - so pile your case on those agencies too.

Once you have acknowledged the claim and read a dozen or more BW Legal claim defences (tons on here, do search!) then you can show us your plagiarised version, tweaked to suit your case. We will help you fight this as far as you wish to push it.

If nothing else going down this route will buy you time to save up the money to pay them off whereas simply trying to speak to them now will mean having to find the money now and paying everything they ask for.

You are not committing yourself to anything that cannot be rectified later - if by rectified you mean paying up. You do realise that the approach being used is designed to frighten you and get you to pay up regardless of whether it is due or not, don't you?
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
