Just use the initial appeal as it is, or only add in grace periods as well if you wish. You don't want to give parking lie an advantage by seeing all your appeal points otherwise they will start working on "creative" ways of getting round them.

So, initial appeal now, then research the most recent successful appeals from the POPLA Decisions sticky thread. Look for every single point that is applicable.
The should include not the landowner, no standing to issue charges in their own name, inadequate signage, lack of grace periods, ICO and BPA beach by not stating what the ANPR data will be used for, ANPR inaccuracy, and any others that are relevant.

sorry to keep posting slow updates, i visited the site again, i feel they do have a grace period of 15 mins but im not 100% sure, hence my ticket for 18 mins

another problem i have is that there is cctv everywhere. i saw about 8 cameras that cover every corner.

so i am not sure what my play is, if they didnt have CCTV i feel i had a chance but now i need to prove i didnt stop for any longer than park and read t&c, i feel i may have waited a few mins extra to make a call but didnt know that would count!

Did you have a problem finding a space? Driving around looking for a space is not parking.

Do not confuse CCTV with ANPR, the latter is used by parking companies. ANPR is a known flawed system that logs you in and out.

CCTV is mainly used for security and not to do with parking

As beamerguy says, CCTV is not something the parking firm has or can use. All PE have is a camera (ANPR only) at the entrance/exit. Nothing else.

Any CCTV belongs to the site landowner/agents and is not data that can be shared with PE (nor will it be).

thank you everyone for the replies, I really feel the cctv was in place by Parking Eye itself, I looked at the locations as well as the way they were fitted and i strongly feel they were installed the same time as the ANPR. all black cable covers etc etc.

i will still send a appeal and see what to do from there.

a little history regarding the land, the whole building/parking was a post office, it was then sold and the shops are leased out, the parking had a normal pay and display ticket system, then all of a sudden Parking Eye have started operating.

all cameras are with night vision and i would have thought the shops would have installed there own ones rather than the owner or PE doing it.

this PE location gets worse and worse, i bet when i finally get a chance to read the small print it will show 'CCTV is being used to support your parking' or something

    thanks again

Trust us when we say that CCTV cannot be used by PE or for issuing tickets. Involved in CCTV is the data protection act and private companies simply cannot access it. The authorities like the police can but they are not interested in scammers tickets.

CCTV would have been installed by the car park owners for security and nothing to do with the activities of Parking Eye.
Your thoughts are wrong and if you use that in an appeal, you will not win as CCTV is irrelevant.

ParkingEye do NOT use CCTv, please believe us. We've been fighting them for many years, not long after they started and were predicted to be the 'most hated men in Britain'

You will get a rejection letter and then it will be a matter of finding something to win at POPLA.

Not sure what you are showing us here - this small print is on virtually every PE sign I've previously read.
