Parking Eye Court Case

I have a court case with Parking Eye in the next week and have rather stupidly buried my head on the sand thinking that they would back out at last minute - but this is obviously not he case. I have submitted a defense, but really don't want to go to court as it is a day i could do without. I should have been to them to offer to negotiate a settlement earlier, but didn't do this. Am I too late to do this and should I pay the full amount or is there something else I should try first

Have a word with the court to see if it can be done on paper only.

AFAIR if you alert the court in time, they do it without a hearing. They may say write in, so do so but expect to have the case ruled against you. At least you'll save having the morning off.

Paper v Oral tends to be 80% for the claimant.

    When next week?

PE may be able to get their hearing fee refunded

If you are minded to settle, then there is no harm in emailing them with an offer.

At this late stage I would be minded to not mark this WPSTC but head up any offer as

"Open offer to settle court claim xxxxxxx, without admission of liability to save time/ costs for all parties - full and final settlement.

You could email this to enforcement@parkingeye.co.uk

Whilst I do not know your circumstances, any odds are stacked against you with Parking Eye generally, and certainly any hearing on papers only.

The offer had better be a reasonable one.

The beauty of offering in this way is that if this gets to court, you can demonstrate reasonable conduct in trying to resolve this without the need of a hearing.
  • Thank you very much I will give this a go
