Question about notice served to complete on new build

I've been waiting for a new build flat to be finished, which has been significantly delayed. I was finally served notice to complete on Tuesday, giving me 14 days to do so.

Until that point I was told by the sales office, although they didn't tell this to most people, that I can complete in less than 14 days if I wanted to. My solicitor tried this but the developer is insisting no completions can take place in September, so Tuesday 4th October needs to stick. I suppose I can try and push for Monday 3rd as that's the first working day of October but it makes little difference.

Tuesday 4th is the final 14th day and I'm probably worrying unnecessarily, but that concerns me. If something went wrong and I had tried to complete say 10 days after notice had been served, at least I'd have an extra 4 days to try and resolve things.

I'm trying to reassure myself that for almost all completions there is no 'notice', you agree to complete on a specific date and if that doesn't happen there are severe repercussions.

Should I not worry and what could go wrong? I'm also using the Help to Buy equity loan scheme, so would my solicitor leave the request of mortgage funds and the HTB loan until the day before (hence potential issues)?

    As you, the exact date of completion is normally fixed at exchange.
    Don't panic, just make sure your Solicitor has everything they need for completion on 4th.
  • It's the norm with new builds that they serve notice 10 working days before and they specify the date. We've already been given an expected completion date but won't know for definite until they officially serve notice.

    I don't know what you mean about things going wrong? Your solicitor will just make sure it happens.

    Not necessarily for new build.. the developer wouldn't know when they can complete building it at the point of exchange.

    They do usually have a longstop date which acts as a guarantee that they must complete before then or you can walk away from the contract with all money refunded.

    OP, I think you just need to be patient, and leave it to your solicitors, unless you have some legitimate reasons to believe something will go wrong and your solicitors are not aware of them. If the developer have served you a notice of completion and your solicitors have no objection, it's very rare for things to go wrong at this stage..
