Ticket in your own parking space - READ this!!

Will let you know how we get on - it's my daughter that is fighting this one!!!

Had own flat with assigned car park space - she doesn't drive but boyfriend parked there. There had recently been new parking restrictions put in - without any agreements from flat owners so we're using the above to fight them. UKPC is the company.

As she won't pay they are now hassling her and we've had enough so threatening them with being sued as this constitues trespass as they need to come onto your land (the car parking space) to ticket your car!!!

Don't take lying down!

    Have you stopped to read any posts or threads here? We help with these every day and don't need links to the 'Roger Davy v UKPC' case nor parking cowboys or anywhere !

    Read how to appeal to UKPC if it's a recent ticket, or read about 'ignore the debt collector' stage in the NEWBIES thread. It also covers small claims defences and we DO see UKPC cases here which go to a hearing.

    Some win, some lose and it being your own space does not make it void, especially if the boyfriend is only a tenant (or even a leaseholder who usually only owns the flat, not the space).

    Do the signs have planning permission and advertising consent?

    then let the management company know that they are committing a criminal offence under the town and country planning act ( control of advertising)

    Is this land part of your daughters demised property or communal land? If the former, then Davey v UKPC may be apt, if the latter, what does the lease say about parking permits?

    If it's her boyfriend's car, how come she's received the parking charge? Have I missed something?
